Expunging a Bexar County Arrest Record
Arrest records in Bexar County remain on file unless a court orders expunction or nondisclosure. Texas law governs this under Texas Code of Criminal Procedure Chapter 55. You may qualify if charges were dismissed, you were acquitted, or the arrest did not lead to a conviction. You must file a petition with the district court in Bexar County to begin.
If granted, all agencies with those records, including the Sheriff's Office, the Adult Detention Center, and the Central Records Division, must destroy their copies. This includes any booking photos on file. After expunction, you can legally say the arrest did not happen. An order of nondisclosure is a separate option that seals records without destroying them.
